Pre-Nuptial Agreements

Prenuptial agreements are not just the terrain of hollywood celebs! More and more couples are deciding to take a practical approach as to how the capital and cash assets they each bring to a marriage should be held for the duration of the marriage and thereafter, in the eventuality of separation or divorce.

It is not just those who intend to marry who can benefit from such an agreement. Partners who intend to unite in a civil ceremony or those who simply wish to cohabit can enter into a prenuptial or cohabitation agreement.

If in the case of separation or divorce the financial aspects of the relationship become contentious and the matter proceeds to court then it is important to understand the court will not be legally bound by a prenuptial or cohabitation agreement.

However, it is likely the court would take into account any existing agreement to assist in their assessment of what the parties intended concerning their finances when they entered into the relevant stage of the relationship.
